Justice Nicklin is not tasked with assessing the truth or accuracy of the allegations, but rather with determining whether they may be published.
The judge also urged the press and public to refrain from speculating about the identity of the man, identified in court as PPT.
“The existence of online speculation, regardless of how confidently or widely repeated, does not authorize anyone to identify or purport authoritatively to identify PPT in connection with these proceedings,” the judge stated.
“Nor does repetition transform speculation into established fact,” he added.
Sara Mansoori KC, counsel for the man, told the court that any publication would carry potentially fatal consequences.
The barrister informed the court that the only factor preventing such a fatal outcome would be the claimant’s detention, which would block his desire to end his life.
She stated that the man attempted suicide after receiving letters from ITN and GNM requesting his response to the allegations, subsequently absconded from hospital, and made a second suicide attempt.
In written submissions, she emphasized that this is not a case of an individual spurring mental health concerns to prevent an impending publication they wish to avoid.
“The claimant has attempted suicide twice as a result of these matters, has been hospitalised for months, been subject to involuntary detention, and examined by more than ten doctors,” she stated.
Mansoori also stated that the claimant has no intention of returning to public life.
Gavin Millar KC, representing ITN and GNM, argued in written submissions that numerous allegations were gathered during a wide-ranging and rigorous investigation, and that there is a strong public interest in publishing them.
He noted that reporters spoke with more than 100 people, and that the resulting allegations indicate a pattern of behaviour.
Millar later stated that many women have been traumatised by the claimant’s alleged conduct and have suffered mental health crises and illness as a result.
He added that while the state has a responsibility to protect life, applying that principle to this case would require intervention in lawful journalistic activities to prevent an autonomous act by the claimant himself.
