France Enacts Landmark Law Restricting Social Media Access for Minors Amid Global Regulatory Shifts

France has implemented a groundbreaking law prohibiting social media use for individuals under 15, becoming the first European nation to adopt such restrictions. The legislation, approved by substantial majorities in both parliamentary chambers, is set to take effect by September 1 and extends existing bans on cellphone usage to high schools. President Emmanuel Macron, whose final term ends in 2027, framed the move as a critical step to address online risks including bullying, exposure to harmful content, and mental health challenges.

The law aligns France with a broader international trend. Australia pioneered similar measures in December 2023, while the U.K. and Canada advanced comparable policies in 2024. Italy, Poland, Portugal, and Spain are also developing regulatory frameworks, with the European Union expected to unveil union-wide standards in September. However, enforcement remains uncertain, as most targeted platforms operate outside France, potentially shifting regulatory responsibility to the European Commission under the Digital Safety Act.

Social media companies have objected to age-based restrictions, arguing existing safeguards suffice. Critics, including some left-wing lawmakers, contend the law lacks clarity on distinguishing educational platforms from social media and raises concerns about online anonymity. The legislation mandates age verification systems but imposes no penalties on children, parents, or platform providers, relying instead on self-regulation by tech companies.

The measure reflects France’s broader push for “technological sovereignty,” aiming to reduce reliance on U.S. and Chinese tech giants. Macron cited the success of alcohol restrictions for minors as precedent, emphasizing developmental vulnerabilities in children under 16. Meanwhile, an EU-commissioned report has proposed further limitations, including no social media access for under-13s without supervision and stricter safety protocols for teens.
