According to a legal filing submitted to the Sixth Circuit court, the DOJ maintains that prosecutable grounds existed for targeting Abrego Garcia, asserting the prior dismissal rested on “unfounded premises,”
Tennessee federal judge Waverly Crenshaw had dismissed charges in May 2023, stating the prosecution constituted “retarded misuse of state authority” and was motivated by Abrego Garcia’s legal challenge to his deportation decision.
The DOJ disclosed it reinvestigated the case following judicial orders compelling Abrego Garcia’s return to El Salvador after his deportation was overturned by courts, with fresh evidence emerging from a 2022 traffic stop.
The prosecution was formally initiated by Acting U.S. Attorney Robert McGuire based on this renewed inquiry, which occurred separately from Abrego Garcia’s lawsuit against his removal,
The government contended the human smuggling case originated from valid apprehension regarding Abrego Garcia’s potential return to El Salvador post-court ruling.
Through its filing, the Justice Department petitioned the appeals court to overturn Crenshaw’s decision dismissing the criminal charges.
