ISLAMABAD: The Capital Development Authority (CDA) management is preparing to take over cancelled properties, with the authority’s law wing directed to initiate proceedings in this matter.
Sources revealed that numerous commercial and residential plots have been entangled in prolonged litigation, prompting management to take decisive action against such properties.
“If someone has been occupying our property for years without valid authorization, without paying the CDA or paying only a nominal amount, we will not overlook such cases,” stated a CDA official.
He noted that CDA’s Member Estate, Mohammad Zaman Wattoo, recently instructed the civic agency’s law wing to provide details of all cancelled plots and the litigation attached to them.
The CDA management decides to move against properties facing litigation
“The undersigned has learned that no follow-up action has been taken on the cancelled plots (residential, commercial, business, agro farms, industrial etc.). The former allottees are taking undue advantage of this situation and entering into agreements with unsuspecting purchasers for the future sale of the said plots and properties. Additionally, the financial interests of CDA are also suffering,” read the letter.
The letter further stated that all concerned officials were directed to compile lists of cancelled plots, including those under litigation, and “submit the same to this office within three days.”
“They [concerned officers] are directed to take necessary legal action to protect the interests of CDA,” the letter added.
Sources indicated that many CDA properties have been facing unwarranted litigation.
“We will review all cases, and if any negligence on the part of CDA officials is identified, we will take action,” said a CDA officer.
“There are rumors that some officials were involved in the prolonged litigation. Without reviewing the records and determining the officials’ roles, we cannot make definitive statements. However, if any negligence or collusion is established, strict action will be taken. We will examine the records of each and every case, which is why we have requested the law wing to share details of all cancelled plots and their associated litigation, including the date of the first case filing,” the officer stated.
“We will ensure the early resolution of all cases. We have a large number of lawyers on our panel and a fully functional law wing,” he added.
Meanwhile, an official stated that CDA management recently discovered that some cancelled plots had been sold in the market, either through stamp papers or through agreements between former allottees and new buyers, prompting the authority to investigate the details of all cancelled plots.
