The Commodity Futures Trading Commission (CFTC) is advancing its commitment to transform financial markets by implementing tailored crypto regulations that encourage innovation. Recently, the agency issued an Advanced Notice of Proposed Rulemaking (ANPRM) to gather public input on digital asset operations under its purview.
Reinforcing America’s Position as the ‘Crypto Capital of the World’
CFTC Chair Michael Selig emphasized that the proposed all-encompassing regulatory structure is a vital move in the government’s effort to strengthen the U.S. as the ‘crypto capital of the world.’ This initiative seeks to fill voids left by current statutes, regulations, and legislative initiatives, particularly following the Senate’s procedural vote in mid-September where the Digital Asset Market CLARITY Act lacked sufficient backing.
“The American people deserve clarity, certainty, and consumer protections in the crypto asset markets and the agency is committed to delivering this by incorporating crypto asset transactions into its uniform national market regulatory framework,” said Selig. “The Commission’s announcement begins our process of new rulemakings grounded in the CEA’s purpose and President Trump’s directive to propose a federal crypto asset regulatory market structure using the CFTC’s existing statutory authorities.”
Furthermore, Selig affirmed that his leadership will focus on preventing and prosecuting incidents akin to FTX. He noted that regulating the crypto industry involves balancing responsible innovation with protecting participants from fraud and abusive practices, ensuring that preventive measures achieve both objectives.
Comments Sought
Consistent with its goals, the CFTC is seeking public feedback on strategies to prevent abusive behaviors in cryptocurrency and related dealings within a cohesive national framework. Additionally, the agency aims to pinpoint industry best practices and compliance standards widely recognized by digital asset market players.
Similarly, the CFTC is inviting perspectives on formalizing contract market registration, which could establish a model for supervising crypto perpetuals or prediction markets.
Use of the Data Gathered
The CFTC stated that the collected information and comments will inform future regulatory efforts, particularly in developing specific and tailored rules for crypto market participants. The agency also noted that only written comments submitted within 60 days of the ANPRM’s publication in the Federal Register will be considered. To ensure transparency, comments will be made available on Regulations.gov.
