Netflix faces a new legal challenge from Christian metal band Demon Hunter regarding the studio’s successful animated film KPop Demon Hunters, with the group alleging trademark infringement and unfair competition.
The Seattle-based band, formed in 2000 and known for their extensive discography, claims that the film’s massive commercial success has created marketplace confusion. Through their corporation Hyde Lane, the group filed a trademark lawsuit in the Central District of California against Netflix, Netflix Studios, and live events promoter AEG Presents on Tuesday (August 18).
The complaint specifically targets the newly announced KPop Demon Hunters live tour, co-produced with AEG, arguing that it creates “almost complete overlap” with the band’s own goods and services. This overlap, they contend, leads to customer confusion, with some believing the acts are affiliated.
The lawsuit highlights an incident involving a customer who spent $500 (£369) on tickets to Demon Hunter’s Albany, New York show but requested a refund to purchase tickets for the “actual KPop Demon Hunters” instead. The complaint accuses the defendants—described as “massive companies that jealously guard and enforce their own intellectual property rights”—of willfully disregarding others’ trademark rights in pursuit of profit.
Hyde Lane is requesting a jury trial, restoration of their trademark interests in Demon Hunter, and an injunction preventing Netflix from using the KPop Demon Hunters name. Additionally, they seek restitution and treble damages. Neither Netflix nor AEG has publicly responded to the allegations.
KPop Demon Hunters has achieved global prominence since its release last year, becoming Netflix’s most-watched film of all time. The franchise is expanding with sequels and the live tour, while art books and a Criterion Collection Blu-ray remain available for pre-order.
