Bad actors could obtain the data, but existing purchase controls already reduce that risk. Intelligence agencies vet potential customers’ infrastructure to prevent the data from reaching adversaries or malicious entities.
However, using this data as AI training material creates new traceability challenges. Unlike commercial datasets, whose provenance can be tracked through planted contact details, AI training data’s origin fades into the model itself. Additionally, the practice fosters an extractive economy where wealthier nations far from conflict zones profit from the mortal dangers faced by frontline states, potentially incentivising perpetual war for digital gain.
A fraught new frontier
Current laws govern how militaries wage war but say little about what happens when combat‑generated records are stripped of operational context, packaged as data, and licensed to companies whose products circulate globally.
The obligations of firms that build these AI systems remain undefined. Ukraine is implementing access controls, as outlined in the recent UK‑Ukraine AI agreement, yet no government is actively regulating the flow of data once it has been absorbed into models and re‑enters civilian markets.
These records contain human lives. Soldiers and civilians captured in the imagery never consented to become training material for products that may be sold years later. Sensor readings, camera footage, and coordinates from civilians fleeing drone strikes now shape how future autonomous systems make decisions.
This raises a consent problem. Individuals featured in the data—whether targets, operators, or bystanders—become part of training sets without permission. Autonomous capabilities derived from such data do not stop at the battlefield; they migrate into other military or commercial systems such as delivery drones or agricultural machinery. Errors and biases embedded in the original data travel with the model into civilian use.
Battlefield data should not be treated as ordinary commercial material. Currently, no agency or regulator has jurisdiction over this issue. In the meantime, governments that grant access to defence data should manage it like controlled weapons transfers: record its origin, license its users, and restrict onward sharing. Ukraine has begun addressing this through its Avengers Labs program, which lets companies train models on battlefield data without direct access to sensitive databases. Yet this only partially mitigates the broader concerns.
