Donald Trump faces legal action from two U.S. media organizations over Truth Social’s premium service granting $100,000 monthly subscribers priority access to the former president’s social media content.
The legal challenge was initiated Wednesday in New York federal court by The Intercept and Freedom of the Press Foundation. The complaint asserts that TMTG’s arrangement creates an unethical hierarchy of information distribution, arguing that charging exorbitant fees for early delivery of Trump’s public communications violates constitutional principles.
Advocates claim the president’s use of the platform to influence financial markets – particularly during critical events like international conflicts – should remain freely accessible. Premium users receive posts in seconds ahead of general public availability, a privilege criticized as creating a two-tier system where wealth determines access to potentially market-moving information.
TMTG President Donald Trump Media & Technology Group has maintained that the service, dubbed Truth API when launched mid-July, provides legitimate business value to corporate clients requiring accelerated data feeds. The company contends that paid API services exist across media platforms, positioning Truth Social as merely an extension of this established practice.
With Trump maintaining 13 million followers as Truth Social’s top user surpassing his eldest son Donald Trump Jr.’s 7.5 million-account, the platform’s information hierarchy carries significant weight. Legal filings characterize Truth API as “a blatantly corrupt scheme” exploiting public discourse for private gain, noting TMTG’s ownership structure gives Trump direct financial stakes in the service’s success.
In its defense, TMTG spokesperson referenced competing platforms’ similar subscription models while framing the lawsuit as an attempt to suppress the former president’s speech following his de-platforming from major social networks. The response also accused petitioners of violating its terms of service.
