Germany Moves to Dismiss Nicaragua’s Genocide Facilitation Case at ICJ

Germany has asked the International Court of Justice to dismiss a case filed by Nicaragua accusing Berlin of facilitating genocide through its support of Israel.

German legal teams will begin four days of hearings at the ICJ in The Hague, the UN’s principal judicial organ for interstate disputes.

The dispute originated in 2024 after Israel launched its military offensive in Gaza. Nicaragua had sought emergency measures compelling Germany to cease all aid, especially military supplies, to Israel.

The ICJ rejected Nicaragua’s emergency request in April 2024, ruling that the circumstances did not warrant such measures.

The case remains active, and Germany is now pursuing its dismissal, arguing either that the court lacks jurisdiction or that Nicaragua’s claims are legally insufficient.

Berlin has submitted preliminary objections challenging the court’s jurisdiction and the admissibility of Nicaragua’s claims, according to an ICJ statement.

The specific arguments in Berlin’s filing have not been disclosed publicly.

Genocide claim

Following Germany’s arguments on Monday, Nicaragua will reply, with both nations scheduled to return to the court on Wednesday and Thursday.

The court typically issues a ruling in such proceedings within six months.

The ICJ may either dismiss the case entirely in Germany’s favor or rule against Berlin, in which event the matter would proceed to a full merits hearing.

During April 2024 hearings, Nicaragua accused Germany of hypocrisy, providing aid to Gaza while arming Israel.

Nicaragua’s ambassador to the Netherlands, Carlos José Argüello Gómez, stated that Germany appeared unable to distinguish between self-defense and genocide.

Germany countered that Nicaragua’s case was grossly biased and strongly denied violating the 1948 UN Genocide Convention.

Israel began its Gaza offensive in response to the October 7, 2023 attacks by Hamas-led militants.

Citing its Nazi history, Germany told the court that Israel’s security lies at the core of its foreign policy.

Germany stated that its arms exports to Israel undergo detailed scrutiny exceeding international legal requirements.

This case is distinct from the separate ICJ proceeding in which South Africa accuses Israel of genocide in Gaza, a charge Israel denies.

ICJ rulings are binding but unenforceable. For instance, the court ordered Russia to halt its invasion of Ukraine, a directive Moscow has ignored.
