HONG KONG — The Hong Kong government proposed legislation on Monday that would grant the city’s leader the authority to designate certain criminal acts as national security offenses, intensifying efforts to suppress challenges to governance amid concerns over eroding freedoms.
Following widespread pro-democracy protests in 2019, Beijing imposed a national security law that has since been used to arrest numerous activists. In 2024, the city enacted additional security legislation targeting offenses such as espionage and disclosure of state secrets.
Critics argue these laws have curtailed the city’s traditionally guaranteed civil liberties, though authorities maintain they are essential for maintaining stability. The Security Bureau and Department of Justice submitted a document to the legislature proposing subsidiary legislation to clarify the classification mechanism for offenses deemed to endanger national security.
Under the proposal, if the chief executive issues a certificate determining that a criminal case involves national security, that determination would apply. Additionally, if a suspect faces both national security charges and alternative charges for the same act, those alternatives would also be classified as national security offenses.
Authorities stated that amid complex geopolitical conditions, clearly defining this mechanism through subsidiary legislation would strengthen the legal framework and enforcement capabilities for safeguarding national security.
The government emphasized the legislation aims to refine procedural details and enhance certainty in implementing existing provisions, asserting it does not create new criminal offenses, penalties, or enforcement powers.
The city intends to expedite the legislative process and will finalize the proposal after consulting with lawmakers. The legislation will take effect upon publication in the government gazette.
