Hospitals in states with abortion bans established operational standards to shield clinicians from legal repercussions when delivering abortion care in life-threatening maternal cases, according to a new analysis.

The research, based on interviews with 34 healthcare professionals across nine high-birth-volume hospitals in abortion ban states, identified six key strategies to maintain evidence-based reproductive healthcare despite legal constraints:

  1. “Procurement of criminal defense resources for medical staff”
  2. “Establishing employment safeguards and healthcare benefits for workers”
  3. “Defining institutional abortion policies to align with the broadest state law allowances”
  4. “Structured decision-making frameworks for maternal indication exemptions”
  5. “Collaboration with other hospitals to standardize legal interpretation”
  6. “Proactive legal advocacy and strategic litigation efforts”

Experts noted these measures improved employee retention, recruitment, and the breadth of reproductive care offered, stated Dr. Deepshikha Ashana of Duke University and her team in their JAMA Network Open publication.
