Senate Bipartisan Legislation Targets NIL Regulation and Transfer Portal Reform in College Sports]
Sens. Ted Cruz, R-Texas, and Maria Cantwell, D-Wash., introduced bipartisan legislation aimed at addressing the ongoing turmoil in college athletics, particularly regarding name, image and likeness (NIL) compensation and transfer portal regulations.
“This is a stability bill, not just an NIL bill,” Cruz said, referencing the name, image and likeness payments that have led to football rosters with $30 million payrolls and reshaped the industry.
The bill, titled the Protect College Sports Act (PCSA), represents a compromise between competing legislative proposals and aims to provide clarity amid growing concerns about the sustainability of college sports programs, particularly in women’s and Olympic sports that rely on revenue from football and basketball.
Cantwell emphasized the need for systemic reform, stating that the college sports system is experiencing significant instability that threatens its foundational structure.
The legislation includes targeted antitrust protection in exchange for specific protections for athletes, including guarantees for health insurance and scholarships, along with stricter regulations for third-party NIL deals.
Key provisions include limiting players to one unrestricted transfer over their college careers and establishing a five-year eligibility period. The bill also prohibits midseason coaching changes, addressing concerns about program disruption during competitive seasons.
The legislation would reworks the Sports Broadcasting Act to allow conferences to pool their television rights, potentially generating significant revenue increases that must dedicate a portion to support women’s and Olympic sports.
The bill takes a neutral stance on the classification of college athletes as employees, instead focusing on preserving the collegiate experience for all student-athletes while addressing the concerns of those who may pursue professional careers.
