Swiss Court Rejects Palantir’s Bid to Force Magazine Publication of Rebuttals]
US technology company Palantir has been denied its attempt to compel a Swiss independent magazine to publish responses to articles detailing the Swiss government’s rejection of the firm’s services.
A Zurich commercial court ruled against the data analytics company on 22 of 23 counts, dismissing most counterstatement requests from Palantir and its Swiss subsidiary. The court determined that only one passage across all articles warranted a published response from the company.
The investigation, published by Republik and Swiss research collective WAV in December, marked one of the first major “failure narratives” about Palantir, according to the journalists involved. Over the course of a year-long inquiry, they submitted numerous freedom of information requests and revealed that despite Palantir’s nearly four-year presence in Switzerland, the firm had secured no government contracts.
This narrative—that Palantir failed to penetrate the Swiss market—prompted the subsequent legal action. The articles sparked discussion among European and UK officials about the necessity of Palantir’s technology, though the company maintains Switzerland was not a priority for its regional expansion.
The journalists stated they interviewed company executives and provided a comprehensive list of questions prior to publication. However, Palantir demanded a detailed rebuttal exceeding the investigation’s scope. When refused, the company sued in Swiss commercial court. While Swiss media law permits right-of-reply requests, such responses must be concise and factually grounded.
The court ordered Palantir to cover 95% of the SFr9,000 ($11,000) in costs and pay Republik SFr9,900 in legal expenses.
Jennifer Steiner, co-founder of WAV, commented: “It was a lot of work and time invested. After four months waiting for a verdict, it’s good to have such a ruling now.”
Balz Oertli, a WAV researcher, added: “We invested a great deal of effort into this case, and we are very pleased with the outcome.”
The sole exception involved a Republik article titled “Why Palantir is becoming a risk for Switzerland,” which reported that Palantir’s Foundry platform was originally developed for US counter-insurgency operations in Afghanistan and Iraq. The court ordered the magazine to publish a brief counterstatement disputing this claim.
Palantir stated: “We welcome that the Zurich commercial court confirmed our right to publish a counterstatement. It’s a critical part of open debate in our society to hear both sides on important topics.”
