The question of how to navigate the evolving digital asset landscape dominated discussions at a recent Crain’s New York Business event, spanning topics from tokenization to compliance and cybersecurity. Rather than waiting for legislative action from Congress, industry practitioners are actively building solutions tailored to the current regulatory environment.
Adam Schumann, vice president of legal at OKX, highlighted the inherent legal complexities facing U.S. firms. With obligations spanning federal statutes, federal agencies, state laws, and state regulators, the pace of regulatory development is highly inconsistent. “You want general consistency, but you’re not going to reach uniformity,” Schumann noted. In the absence of unified federal guidance, firms are forced to navigate the requirements state by state and country by country, while regulatory agencies scramble to address the most pressing gaps.
This fragmented regulatory landscape carries significant financial and operational costs. Aravind Raju, CFO of Uphold, explained that compliance has become one of the company’s largest departments, dedicated to building customized solutions for each state’s specific requirements. Raju anticipates that as regulatory frameworks eventually become clearer and more aligned, these resources can be repurposed. For financial advisors, the key takeaway is that robust compliance is a substantial cost of doing business in the digital asset space, and the firms that manage it most efficiently will gain a distinct competitive edge.
Rather than fostering collaborative, shared infrastructure, this regulatory duplication has paradoxically led to the rise of isolated, private networks. Over the past year, numerous institutions have launched proprietary, closed systems for tokenized assets, stablecoins, and securities ledgers. Lewis Tuff, CEO of Twilight, a firm specializing in clearing and settlement technology, pointed out the inefficiency of this trend: because these private networks cannot easily interoperate, individual firms are ultimately forced to rebuild the same foundational connections from scratch.
