The U.S. government has accused China’s Moonshot AI of conducting a systematic campaign to replicate advanced artificial intelligence models developed by American firms, using techniques including data distillation and unauthorized access to restricted computing infrastructure.
Michael Kratsios, former Science and Technology Adviser to President Donald Trump, alleged in a social media post Wednesday that Moonshot AI employed distillation—a process where a smaller AI model extracts knowledge from a more powerful system—to replicate capabilities from Anthropic’s Fable AI in developing its Kimi K3 model. He claimed Moonshot also utilized Nvidia’s GB300 Grace Blackwell servers, despite U.S. export restrictions implemented in 2022 to limit Chinese access to cutting-edge chips.
The accusations follow heightened global scrutiny over the proliferation of Chinese AI technologies. Kratsios emphasized that the U.S. government possesses evidence of Moonshot’s activities, which allegedly circumvented legal safeguards by leveraging smuggled hardware and proprietary data extraction methods. He warned that such practices threaten American innovation and intellectual property (IP) protections.
Moonshot AI’s Kimi K3 model, unveiled last week, has been praised for its rapid development and parity with leading Western AI systems. The company announced plans to open-source Kimi K3 on July 27, enabling public access and modification of the platform. In response to the allegations, Moonshot attributed its advancements to “independent research and international collaboration,” dismissing claims of IP theft.
The Biden administration has intensified efforts to counter AI technology theft, with Treasury Secretary Scott Bessent stating sanctions could be imposed on foreign entities engaging in “industrial-scale distillation attacks.” Bessent stressed that while open-source AI promotes innovation, it should not enable exploitation of U.S. IP. His remarks follow a series of similar accusations, including a June report by Anthropic alleging Alibaba used distillation techniques to replicate its Claude AI models.
Earlier this month, the White House announced plans to collaborate more closely with domestic AI developers to prevent foreign campaigns aimed at “systematically undermining U.S. research and development.” Kratsios reiterated these concerns, calling the theft of proprietary data a critical threat to national security and technological sovereignty.
China’s Ministry of Foreign Affairs has not yet responded to the latest allegations but has historically maintained that its AI advancements stem from domestic innovation and partnerships with global academic institutions. The issue coincides with rising tensions between the U.S. and China, including preparations for a summit between President Trump and President Xi Jinping scheduled for September.
In December, U.S. officials confirmed U.S. Customs and Border Protection seized AI chips at multiple ports, disrupting shipments linked to Chinese AI firms. Despite these measures, reports indicate continued attempts to bypass trade controls, prompting discussions in Congress about stricter enforcement of export regulations and penalties for IP violations.
The dispute underscores global debates over balancing open-source collaboration with national security interests. While Chinese developers insist on the legitimacy of their progress, U.S. policymakers warn that unchecked AI proliferation could destabilize technological and economic dominance. The situation also highlights evolving challenges in regulating AI development amid geopolitical rivalries.
