While the policy aimed to restore competitive balance, its execution created new vulnerabilities.

“Any competent legal team should have anticipated that restricting eligibility would prompt lawsuits challenging the underlying assumptions about player rights and institutional obligations,” Mars observed.

Instead of comprehensive reform, the NCAA pursued broad federal legislation hoping to shield itself from individual legal challenges — a strategy that has yielded little concrete progress despite years of lobbying efforts.

Recent court rulings, including decisions from the Supreme Court, have repeatedly undermined NCAA restrictions on player compensation and mobility. Yet rather than adapt proactively, the organization has relied on Congress to preemptively legislate protections — hoping for a comprehensive solution that addresses everything from Name, Image and Likeness (NIL) rights to transfer portal regulations.

Federal lawmakers, however, remain skeptical of ceding regulatory authority to an organization struggling to maintain relevance in modern athletics. Instead of supporting meaningful reform, they’ve offered symbolic gestures while accepting campaign contributions from stakeholders invested in maintaining the status quo.

The result is a patchwork of inconsistent policies and unresolved disputes — exemplified by cases like Wright’s journey from Ole Miss to the NFL and now potentially to LSU via the transfer portal.

Meanwhile, financial incentives continue driving realignment across conferences, with schools courting top-tier athletes through NIL collectives and creative scholarship arrangements.

As more players follow similar paths, the line between professional sports and college athletics grows increasingly blurred — raising fundamental questions about amateurism, fair competition, and the future of intercollegiate athletics.

Compensation disparities only amplify these concerns. NFL rookie minimum salaries far exceed typical college stipends, yet some players are choosing to return to campus where endorsements and NIL deals may prove more lucrative than entry-level professional contracts.

For instance, practice squad weekly payments often fall below what top college programs offer through booster-funded initiatives — making “returning to school” economically attractive despite sacrificing guaranteed NFL income.

The NCAA must refocus its priorities toward clear eligibility guidelines instead of lobbying for sweeping legislation that attempts to regulate every aspect of college athletics simultaneously.

Simple policies work best: five years to play four seasons, reasonable transfer restrictions, and finality once athletes leave for professional careers. Such straightforward frameworks preserve both opportunity and integrity without overreaching into areas beyond the NCAA’s expertise.

Until then, absurd scenarios will persist — like reporters covering college football recruiting strategies involving NFL personnel departments scouting waiver wire transactions alongside traditional high school prospects.
