Nevertheless, the initiative raises a fundamental question for public‑health policymakers: how can we determine whether the label truly improves consumer health?
Potential metrics include sales of certified goods and consumer awareness of the seal. However, neither indicator alone reveals whether residents ultimately eat better or experience health gains.
Three critical tests can provide more insightful answers.
Test No. 1: Who Responds To The Label?
Nutrition labels can shape purchasing decisions, yet response varies widely among consumer groups.
Research by the Natural Marketing Institute, incorporated into our Georgetown University study All Indulgent Products Are Not Created Equal, highlighted a stark contrast.
Among the most health‑focused consumers (the “Well Beings”), 84 % selected items based on the Nutrition Facts panel. In contrast, only 24 % of the least health‑active segment—referred to as “Eat, Drink & Be Merrys”—did so. This low‑engagement group also recorded the highest obesity rates.
Earlier BMI‑based analyses revealed the same trend: individuals of healthy weight were significantly more likely than those with obesity to use front‑of‑package nutrition information and ingredient lists.
This creates a paradox: the consumers most likely to act on healthier labeling may be those who need the guidance least.
Consequently, the key question is not whether Californians notice the seal, but whether it reaches the populations whose eating habits policymakers aim to modify.
Test No. 2: Which Foods Actually Matter?
California’s policy also prompts an examination of the foods it targets.
Our Why They Buy research evaluated indulgent‑food purchases across different body‑weight groups, revealing significant but non‑uniform disparities.
For instance, compared with healthy‑weight shoppers, those with obesity showed a purchase‑index gap of +27.0 for regular soda, while the gap for chocolate candy was only +1.7—statistically insignificant. Non‑chocolate candy also displayed no meaningful difference between the groups.
These differences extend beyond purchasing. NHANES data analyzed for our Georgetown study indicated that beverages contributed 7.9 % of total calories, whereas candy accounted for just 1.9 %.
While this does not imply that candy is healthy or that processing is irrelevant, it underscores that foods grouped under a broad policy label can vary in consumption patterns, caloric impact, and obesity risk.
Treating them as uniformly problematic risks converting a useful classification into an ineffective policy tool.
Food manufacturers face similar considerations. The seal could motivate reformulation or new product development aimed at certification. Yet, the most valuable innovation may not be the seal itself, but rather reductions in calories, sugar, or portion sizes for categories that drive over‑consumption.
Test No. 3: Does Changing Purchases Improve Health?
This may be the most pivotal assessment.
Chile offers a relevant precedent. Its prominent black‑warning labels, paired with taxes and marketing restrictions, significantly altered purchases of targeted foods and nutrients. Despite these gains, obesity rates continued to rise after implementation.
These outcomes do not indicate policy failure; obesity is influenced by numerous factors, and rates might have escalated faster without intervention.
However, the experience illustrates a key limitation: using purchase behavior as the endpoint overlooks the ultimate health objective.
Consumers can shift to other products that may not lower overall calorie intake, and as our research suggests, those most responsive to nutrition cues are often not the individuals whose habits most require change.
The Real Test Is What Happens Next
California should be commended for pioneering this approach. Yet, if AB 2244’s purpose is to enhance dietary habits, success must be gauged beyond seal recognition or increased certified‑product sales.
The state should monitor which consumer segments respond, which food categories experience actual change, and what items replace the certified products on shoppers’ plates. Most importantly, it must assess whether these shifts translate into improved diets and health outcomes.
As the federal government develops its own ultra‑processed food definition, California’s real‑world findings could offer critical insights into what strategies work—and what do not.
A label can shape what consumers see on the shelf; the ultimate measure is whether it changes how they eat.
