A federal judge in Manhattan has nullified a Trump administration policy that suspended immigrant visa processing for applicants from 75 countries, ruling that the policy exceeded the legal authority granted to the Secretary of State.
In a Friday ruling, Judge Jeannette Vargas, a Biden appointee, declared the policy “patently unlawful” and in direct conflict with federal immigration statutes, which explicitly limit the Secretary of State’s control over consular officers’ decisions regarding immigrant visa approvals.
“The policy’s categorical prohibition of immigrant visas based solely on nationality constitutes a direct violation of the statutory framework governing visa processing,” Judge Vargas wrote in her opinion.
The decision follows a lawsuit filed by immigrant advocacy organizations including Catholic Legal Immigration Network, Inc., and African Communities Together, alongside visa applicants and U.S. citizens sponsoring family members from the affected nations.
The suspension, implemented in January 2024, impacted applicants from Latin America (Brazil, Colombia, Uruguay), Balkan states (Bosnia, Albania), South Asia (Pakistan, Bangladesh), and numerous African, Middle Eastern, and Caribbean countries.
The State Department previously justified the restrictions, citing elevated risks of applicants becoming public charges relying on government assistance programs in the U.S.
The ruling adds to a series of immigration-related legal challenges confronting the Trump administration, which has faced criticism for measures including a 39-nation travel ban enacted January 1 and a December pause on diversity visa lotteries.
Civil rights organizations have argued such policies infringe upon constitutional protections, raising concerns about discriminatory impacts on minority communities.
The Department of State has not yet responded to requests for comment regarding the court’s decision.
