Custodial agents prompted Tunick to share a passcode that triggered automatic data erasure using Graphene OS, a privacy-focused operating system he adopted after concerns about government surveillance.
Charged with obstruction of justice, Tunick’s case has drawn attention for its implications on digital privacy rights. His legal team argues that the destruction of device data—performed via a feature designed for security—should not constitute a criminal act.
Tunick, an activist involved in protests against Atlanta’s planned “Cop City” development, faces up to five years in prison. He claims authorities targeted him under National Security Presidential Memorandum-7 (NSPM-7), which expands federal definitions of terrorism to include actions opposing immigration enforcement.
U.S. Customs and Border Protection maintains broad authority to inspect devices at borders, though officials clarify such searches occur in under 0.01% of international arrivals. Tunick’s case represents a potential precedent for penalizing privacy-enhancing technologies under national security pretexts.
