A lawsuit filed by Bad Bunny’s former partner alleging unauthorized use of her voice on his 2022 song “Dos Mil 16” will move forward after a Puerto Rico Supreme Court ruling allowed the claim to proceed. The court found sufficient evidence that Carliz De La Cruz Hernández presents a valid claim that the recording’s inclusion violated her right to protect her identity from commercial exploitation.
The 80-page decision, obtained by Rolling Stone, upholds De La Cruz Hernández’s allegations that Benito Martinez Ocasio (Bad Bunny) used her voice memo without consent across streaming platforms, social media, and promotional campaigns to amplify their relationship narrative and boost album sales. She asserts that the voice note, recorded in 2015 during their intermittent relationship, was incorporated into tracks “Pa Ti” and “Dos Mil 16” from the album A Summer Without You, generating commercial value without her compensation.
The court rejected Bad Bunny’s efforts to dismiss the claim, ruling that De La Cruz Hernández’s filings adequately support her argument that her voice performance might qualify for copyright protection. However, the justices barred her from seeking damages related to “Pa Ti,” citing an expired statute of limitations.
Attempts to contact Bad Bunny’s legal representatives were unsuccessful. A dissenting judge argued that both claims lacked legal merit and should have been dismissed.
