Johnson, the president‑elect of the National Association of Criminal Defense Lawyers, suggested that Tennessee might pursue an execution using an alternative method.
Such a move would entail additional legal steps, including approval from the governor’s office and possibly the state legislature.
Following Pike’s survival, Tennessee politicians have urged that her death sentence be carried out via another method.
Senator Marsha Blackburn, the Republican gubernatorial candidate in the upcoming election, declared, “Bring back the electric chair.”
Representative Tim Burchett announced on social media that he has introduced a bill to reinstate hanging.
Tennessee might be permitted to employ the electric chair, since Pike’s crime occurred in 1995, prior to the state’s revision of its execution statutes.
She would have to formally waive her right to lethal injection, a decision that must be made by Pike herself, according to Vanderbilt University law professor Chris Slobogin.
Because Pike’s precise medical condition remains unclear, Slobogin noted that the state could be prevented from pursuing another execution, irrespective of the method chosen.
He also explained that executing an individual who lacks the mental capacity to comprehend the punishment would constitute cruel and unusual punishment.
Historically, this protection has applied to inmates with dementia or psychosis, but experts suggest Pike may have sustained brain damage.
There is precedent for states adopting an alternative execution method for a death‑row inmate.
In 2024, Alabama carried out the execution of Kenneth Eugene Smith using nitrogen gas after its original plan of lethal injection failed.
