Israeli prosecutors have charged 12 prison guards with reckless homicide in connection with the 2023 beating death of Palestinian detainee Thaer Abu Asab, marking one of the rare criminal cases pursued by Israeli authorities over alleged abuse in custody.
According to an official statement, the guards entered Abu Asab’s cell at the Ketziot detention center in Israel’s southern Negev desert during an evening head count in November 2023, where they physically assaulted him and several other inmates. The prosecutors allege the guards punched, kicked, and struck the prisoners with clubs, leading to Abu Asab’s collapse shortly afterward. The 38-year-old, who hailed from the occupied West Bank, was transported to the prison clinic and later to a hospital, where he was pronounced dead. Medical examiners determined his death resulted from blunt-force trauma that severely damaged his heart and respiratory system.
The incident occurred amid heightened scrutiny over Israel’s treatment of Palestinian detainees, particularly following increased restrictions imposed by far-right National Security Minister Itamar Ben-Gvir on individuals classified as “security prisoners” after the October 2023 Hamas-led attacks on southern Israel.
Human rights organization the Public Committee Against Torture in Israel reported that over 100 Palestinian detainees have died in custody since October 2023, adding that this case represents the first known prosecution related to such fatalities. In a statement, the group emphasized that many of the deceased appeared to be in good health upon arrest but died due to starvation, neglect, or physical abuse.
International observers have long criticized Israel for what they describe as a culture of impunity regarding the treatment of Palestinian prisoners. This criticism intensified earlier this year when Israeli military prosecutors dropped charges against five reserve soldiers accused of assaulting a Palestinian detainee, citing insufficient evidence.

Prosecutors revealed that Abu Asab had inquired about a potential ceasefire in Gaza while speaking with a guard at the time of the clash. The shift commander, Walid Khatib, reportedly ordered the raid on the cell to “show the prisoners that there is no ceasefire,” defying standard protocol. Khatib is accused of personally overseeing the assault and striking detainees himself. Court documents suggest he expressed personal grief over the deaths of Druze soldiers in Gaza, which may have influenced his actions.
In addition to reckless homicide, the indictment includes charges of aggravated assault against multiple victims involved in the same incident. Defense attorneys for the accused maintain their clients’ innocence, with lawyer Adi Keidar noting that while he has communicated with several defendants, the prosecution faces significant challenges in securing convictions.
Abu Asab, a member of Fatah and a convicted offender serving a 25-year sentence, remained a contentious figure within Palestinian political circles. His family continues to seek accountability, with his brother Muadh Abu Asab appealing for the return of his remains for traditional burial rites.
Israeli military and prison service officials declined to comment beyond confirming the indictment. The Shin Bet did not respond to requests for additional information.
Sari Bashi, director of the Public Committee Against Torture in Israel, praised the indictment as a meaningful deviation from systemic inaction. “This case stands out as an exception to the broader pattern of impunity surrounding detainee abuse,” she stated. “It is crucial that these proceedings lead to transparent outcomes and signal genuine commitment to justice.”
